Agreement.

Who these terms apply to and when they start.

These Terms of Service ("Terms") are an agreement between you and Resonate Agency LLC, a Florida limited liability company doing business as Point Higher, based in Miami, Florida. It builds and operates TripleReviews ("TripleReviews", "we", "us"). They apply to any business, agency or person who creates an account or uses the TripleReviews service, website or apps (the "Service").

By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of a company, you confirm you are allowed to bind that company to these Terms.

Accounts.

Signing up, users, and keeping access secure.

You need an account to use the Service. Give us accurate information and keep it up to date.

You are responsible for everything that happens under your account, including what your team members do. Keep login details private and tell us right away at info@triplereviews.com if you think someone accessed your account without permission.

Today each account has one login, the owner’s. When team logins arrive, each user must have their own login.

Plans, billing and cancellation.

Pricing, SMS usage, renewals, refunds and cancelling.

Plans are billed per location, monthly or annually, in advance. Current prices and what each plan includes are listed on our pricing page. A location is one Google Business Profile.

Google Business Profile is a free product from Google. Your TripleReviews subscription, and the Managed by Point Higher add-on if you choose it, pay only for TripleReviews' own service and our team's work, not for your Business Profile. You never need to pay us to have or keep a Business Profile, and you can always manage it yourself, free, at business.google.com.

Coming soon. The text message allowance below applies once the feature is available in your account.

Each plan includes a monthly allowance of text messages per location. Texts above the allowance are billed at the rate shown on the pricing page. We show usage in your account and warn you before you reach the limit.

Plans renew automatically: monthly plans every month and annual plans every year, until you cancel. Prices are in US dollars, and any sales tax that applies is added to your invoice.

How to cancel. Email info@triplereviews.com from your account’s email address with “Cancel” in the subject. We confirm in writing within 1 business day. Cancelling stops the next renewal, and your plan stays active until the end of the period you paid for.

Annual reminder. We email you at least 30 days before an annual plan renews, with the date and the price it will renew at.

Refunds. Fees already paid, including the one-time setup fee, are not refunded, except where the law requires it.

Receipts and price changes. Every charge comes with an invoice or receipt by email. We tell you at least 30 days before a price change, and it applies from your next billing date after that. Plan changes also apply from your next billing date.

Founding Partners. Growth at $129 per location per month for the first 12 months, then $249 per location per month for as long as the account stays on the plan; a general price change doesn’t change these rates. Setup is included. The first 30 days are a minimum term, then it is month to month. Only for accounts accepted into the program, ten in total.

Your responsibilities.

Customer consent, accurate information, and your team's use.

You are responsible for the customer information you bring into the Service and for having the right to use it, including the consent needed to contact your customers: written consent for texts (section 07) and permission for email (section 05).

You agree to keep your contact lists accurate, remove people who ask not to be contacted, and follow the laws and platform rules that apply to your business.

Sending review requests by email has its own rules, which you accept in your account before your first email goes out. See section 05, Review requests by email.

Review requests by email.

Your promises, our safeguards, and who is responsible for what.

You can use TripleReviews to email your customers and ask them for a review. This section explains what you promise, what we do, and who is responsible for what. You accept it in your account before your first review request goes out.

1. You only add your own customers, with their permission.

Each time you add customers, you confirm that:

  • each person bought from your business or had work done by your business;
  • they gave you their email address themselves, and they agreed to hear from your business by email;
  • they have not asked you to stop contacting them.

We record when you confirmed this and which login confirmed it. Do not add bought, rented or scraped lists, or people you never served. Do not add anyone a second time to get around an unsubscribe.

2. The emails are yours. You are the sender.

Review requests go out in your business's name, about your business, to your customers. We send them for you from a TripleReviews address, and replies go to you. For the purposes of the CAN-SPAM Act and similar laws, your business is the sender. You are responsible for following those laws, including:

  • your business name and the "Replies go to" address are true and belong to you;
  • your mailing address in every email is your real street address or PO Box;
  • you never offer anything (a discount, a gift, a prize, an entry into a draw) in exchange for a review, and you never ask only happy customers.

3. What TripleReviews does for every email.

To help you follow the law and the review sites' rules, we build these into every review request. You cannot turn them off:

  • the same email goes to every customer, with the same review buttons: Google, plus Trustpilot if you turn it on and the experience is from the last 12 months (never Yelp), and the same option to send you a private note as well;
  • your business name in the From line, an honest subject line, and your mailing address at the bottom;
  • an unsubscribe link and one-click unsubscribe. When someone unsubscribes, we stop emailing them for your business right away and keep that choice on file, even if you delete the customer, close your account or start again with the same Google listing;
  • each person gets at most one review request from your business every 365 days and one follow-up: a reminder if they pressed nothing, or, after they pressed a review button and if you take video reviews, one thank-you that asks for a short video (never both, so never more than two emails for one request), nothing more after they sent you a private note or a video or unsubscribed, and emails go out only between 8 AM and 8 PM where your business is;
  • daily sending limits, and we pause sending if too many emails bounce or are marked as spam.

If you turn on Trustpilot, you confirm the Trustpilot page is your business's own and you follow Trustpilot's Guidelines for Businesses: invite every customer the same way, once per experience, only about a recent experience, never staff, family or friends. We hide the Trustpilot button for experiences older than 12 months.

4. We act as your service provider.

We use your customers' information only to provide the service to you: to send the emails you ask for, show you what happened, pass private notes to you, and keep unsubscribes working. We:

  • do not sell it or share it for advertising;
  • do not use it to market to anyone, including our own products;
  • do not use one business's customer list for another business, with one exception: if an address bounces permanently or the person marks one of our emails as spam, we stop sending to that address for every business on TripleReviews. We keep that as a one-way code, not the address;
  • keep it only as long as point 7 says, and delete it when you or the person asks (point 8).

If the law requires something we cannot do, we will tell you. If you believe we are using your customers' information in a way these Terms do not allow, tell us at info@triplereviews.com and we will stop and fix it.

5. Confirming your Google listing.

Before your first review request goes out, we confirm that the Google listing you picked belongs to your business. If your email's web address matches the listing's website, this happens automatically. Otherwise someone on our team calls the phone number on the listing. You may not send review requests for a business you do not own or run.

6. When we pause sending.

We may pause sending for your account, without notice, if bounce or spam-complaint rates are high, if we believe someone is being emailed without permission, or if these Terms or the Acceptable Use Policy are broken. Paused emails stay ready, and we tell you why and how to restart.

7. How long we keep customer information.

  • The email address on each review request: 400 days, then we blank it.
  • Private notes and the contact details on a follow-up: 24 months after you mark it done.
  • Everything about your business, if you or we delete it: erased 60 days later.
  • Unsubscribes, hard bounces and spam complaints: kept as a one-way code (not the address) for as long as the service runs, so the person is never emailed again.

8. Requests from your customers.

If one of your customers asks us to delete their information, we will do it across every account that holds it and may let you know. If they ask you, forward the request to info@triplereviews.com or delete the customer in your account. Either way, their unsubscribe stays on file.

9. You cover claims about your lists.

You agree to defend and pay for claims, fines and costs that come from people you added without permission, or from what you or your team wrote, to the extent the law allows.

10. Video requests.

You can also ask your customers for a short video, or a few words, about their experience. The same promises, safeguards and limits apply as for review requests: your own customers only, at most one video request per person every 365 days plus one reminder, and never after someone unsubscribed.

  • Use each video only within the consent the person gave. Every person agrees that you may keep it and use it to understand customer feedback. You may show it on your website or social media, or share its link, only if they also ticked that they agree to that. Without that tick it stays private, for you only.
  • Your testimonials page on TripleReviews (triplereviews.com/t/…) and the testimonials widget for your website are off until you turn them on. The page shows only videos and words whose consent box named that page; the widget shows only those the person agreed to show on your website. You choose which of them appear, and both say that you chose them. You can turn either off, or hide or delete any item, at any time.
  • Never offer anything (a discount, a gift, a prize, an entry into a draw) in exchange for a video, and never ask only happy customers. A video request you send yourself never shows a review button: the video page asks for a public review only when the person reached it from the review request every customer gets.
  • Do not edit a video in a way that changes what the person said, and do not present it as anything other than what it is: a customer's own words about your business.
  • If a person asks you to take their video down, hide or delete it in your account right away. If they ask us, we delete it.

Acceptable use.

What the service can't be used for.

You must follow our Acceptable Use Policy, which is part of these Terms. In short: every customer gets the same invitation, you never pay or reward anyone for a public review, you never post fake reviews or write reviews for customers, and you only message people who agreed to hear from you (for texts, in writing).

We may suspend sending, or the account, if the Service is used in a way that breaks that policy.

Messaging.

Consent, sending rules, opt-outs and carrier registration.

Texting launches soon. This section applies once texting is turned on in your account. Review requests by email are covered in section 05.

Texts are sent in your business's name, to your customers, through our messaging provider, and follow our SMS terms.

You may text only customers who gave your business prior express written consent to get texts from it, before the first text: for example a text-message checkbox on your booking form, or a text-message consent line on a signed estimate, work order or invoice. Verbal consent alone is not enough. The consent wording must name your business, say the texts are about their job and include a request for feedback or a review, and state: up to 2 texts per completed job, Message and data rates may apply, Reply HELP for help, Reply STOP to opt out, with links to your SMS terms and privacy policy. Agreeing may not be a condition of buying from you, and it must be separate from agreeing to email or calls. We give you wording you can use.

Before texting is turned on, you show us how your customers give consent (a link to your form, or a photo of your paper form). You keep each customer's consent record (the date, how they agreed and the wording they saw) for at least 4 years after the last text, and give it to us within 5 business days when we or a carrier ask. Each time you add customers for texts, or turn on automatic import from your job software, you confirm this with a checkbox, and we record which login confirmed it and when. Do not text anyone who has not agreed or who asked you to stop, in any way.

We build these rules into every text, and you cannot turn them off:

  • your business name at the start of every text, and "Reply STOP to opt out" in every text;
  • only the wording registered for your business with the carriers (just your business name, the customer's first name, the service and the link change), and never offers, coupons or promotions;
  • one review request per job and at most one reminder (up to 2 texts per job), and no more than one review request to the same person every 365 days;
  • texts only between 8 a.m. and 8 p.m. local time;
  • automatic handling of STOP and HELP replies, and of other ways of asking to stop. When someone asks to stop, we stop texting them for your business right away.

US mobile carriers require every business that texts this way to be registered (A2P 10DLC). To text for you, we register your business and its texting program with our messaging provider and The Campaign Registry. You agree to give us accurate details for that, such as your exact legal business name and EIN as on your IRS letter, address, website, a contact person with an email at your business's domain, links to your privacy policy and SMS terms, and proof of how your customers agree to texts, and you authorize us to submit them for this purpose. If your website does not have a privacy policy and SMS terms that cover texts yet, we give you the wording to add.

Carriers may filter, delay or block messages. We do not guarantee delivery, and we are not responsible for carrier decisions.

AI features.

Drafts, classification, and human review.

Coming soon. This section applies once the feature is available in your account.

When these features arrive, the Service will use AI to ask short follow-up questions, sort customer replies, and draft messages and review replies. AI output can be wrong. Nothing is posted to a review site in your name until you approve it, one reply at a time or through an automatic setting you turn on yourself. Replies to public reviews rated 1 to 3 stars always wait for a person to approve them.

You are responsible for reviewing and approving what is sent or posted in your name, except for the automatic features you choose to turn on.

Your data.

Who owns what, exports, and deletion.

You own your data: your customer lists, private notes, testimonials collected for your testimonials page, and your reports. You give us permission to use it only to run, secure and improve the Service for you.

You can ask us for a copy of your data at any time while your account is active, and download your videos yourself. After an account is closed, we delete or anonymize your data within 60 days (nightly backups keep it up to 14 days longer), unless we must keep some of it by law.

Your own tools: if you add webhook addresses, or send your finished jobs to us from Zapier, Make or your own software, you choose where your customers' information goes. Events we send can include a customer's name, email address, phone number and private note. You are responsible for the addresses you add, for the services behind them (for example Zapier or Make) and for how they handle that information, and for having the right to send us the customers you send. Closing your account turns your webhook addresses off.

Reviews and third-party platforms.

Google, Facebook, Yelp and other platforms' own rules.

Google, Facebook, Yelp, Thumbtack, Trustpilot and other review platforms have their own rules. We design the Service to follow them, for example we never ask customers for reviews on Yelp, but you are responsible for your own compliance with each platform's terms.

We do not control those platforms and are not responsible for how they display, filter or remove reviews.

TripleReviews is not a review site. It does not publish reviews or ratings of businesses, keep a business directory or offer reviewer accounts. Your customers post public reviews on the review sites themselves, under those sites’ rules. Your testimonials page shows only the testimonials you choose, and says so.

Trustpilot and TrustScore are trademarks of Trustpilot A/S. TripleReviews is not affiliated with, endorsed by or sponsored by Trustpilot. The Trustpilot button is a plain link to your own Trustpilot page, reviews written through it are labelled “unprompted” by Trustpilot, and reviewers need a Trustpilot account. If you turn it on, you must follow Trustpilot’s guidelines for businesses.

Google Maps content

TripleReviews includes Google Maps features and content, such as a business's Google rating, reviews, review summary and nearby businesses, shown live from Google Maps. Your use of them is subject to the then-current Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.

You must not scrape, copy, store or export Google Maps content from the Service, or use it outside the Service. We may suspend or close an account that breaks these terms or Google's.

Google Business Profile

Google Business Profile is a free product from Google. TripleReviews is not affiliated with, endorsed by or sponsored by Google. Our subscription pays only for TripleReviews' service, not for your Business Profile (see section 03).

Coming soon. Connecting a Google Business Profile is not available yet. The rest of this part applies once it is in your account.

You may connect only Business Profiles that you own or manage. By connecting one, you authorize us to read its reviews and replies and to post, edit or delete replies for you, but only the replies you write or approve in TripleReviews. We never change anything else on your profile.

If you add Managed by Point Higher, you authorize our team in writing, by adding it, to reply to your reviews for you. Every reply we post appears in your account.

You stay the owner of your profile at all times. You can disconnect at any time in Settings or in your Google Account; we then stop accessing your profile and delete what we received from it, as our privacy policy describes.

Replies must follow Google's policies. Google may hold, reject or remove replies, and we do not control those decisions.

Agencies and partners.

Terms for agencies managing clients.

Agencies may manage accounts for their clients. The agency is responsible for having its clients' permission and for its clients' use of the Service under its management. Partner pricing, billing and referral terms are confirmed in a separate partner agreement. An agency that earns a referral fee from us must tell its clients that it is paid when it recommends TripleReviews.

If you manage clients' Google Business Profiles through TripleReviews, you must have each client's written authorization to reply to reviews for them, tell them in writing before you start that Google Business Profile is free from Google, and let them disconnect or take back full control of their profile at any time.

Intellectual property.

Our software, your content.

We own the Service, including the software, design and brand. These Terms do not give you any rights to it beyond using the Service as described.

You keep ownership of your content. If you send us feedback or ideas, we may use them without any obligation to you.

Disclaimers.

What the service does and does not promise.

The Service is provided "as is" and "as available". We do not promise a specific rating, number of reviews, ranking in search results, or amount of revenue. Customers decide what they write and where they post it.

To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability.

Limits on damages.

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data.

Our total liability for any claim related to the Service is limited to the amount you paid us for the Service in the 12 months before the event that led to the claim.

Termination.

When either side can end the agreement.

You can close your account at any time. We may suspend or close an account if these Terms are broken, if payment fails and is not fixed, or if continuing would put other customers, our messaging providers or us at risk. Where reasonable, we will warn you first and give you a chance to fix the problem.

Governing law.

Which laws apply.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Florida, unless the law requires otherwise.

Changes to these terms.

How updates are announced.

We may update these Terms. If a change is significant, we will tell you by email or in the Service at least 30 days before it takes effect. Continuing to use the Service after that means you accept the updated Terms.

What changed on October 8, 2026: section 03 now spells out renewals, how to cancel, the annual renewal reminder, refunds, receipts, price changes and the Founding Partner terms, with the details on our billing page; section 19 explains how we handle complaints; section 02 says each account has one login today; section 09 says you ask us for a copy of your data; section 10 adds the Trustpilot notice and says TripleReviews isn’t a review site; and the Acceptable Use Policy adds the review sites’ rules on staff and family, your own devices, recent customers and pressure. Later the same day: a video request you send yourself never shows a review button, section 09 says we delete a closed account’s data within 60 days, and section 05 says we hide the Trustpilot button for experiences older than 12 months. Nothing you pay changed.

Also new on October 6, 2026: section 05 covers your testimonials page and the testimonials widget (off until you turn them on; only items within each person's consent; you choose what shows), and section 09 covers webhooks and the finished jobs you send us from your own tools, where you are responsible for the addresses you add. Each of these is optional and starts only when you turn it on.

What changed on October 7, 2026: you can add your Trustpilot page; seeing its TrustScore and newest reviews in your dashboard starts only once Trustpilot gives us access, which it hasn’t yet. If you turn it on yourself, your review page also shows a Trustpilot button after the Google one, the same for every customer; section 05 says what you confirm when you do. Yelp is never asked.

What changed on October 6, 2026: the review link in your emails now opens a page with your business's name, where every customer gets the same Google button, a button to record a short video and a way to tell you privately. Section 05 describes the one follow-up each request can get: a reminder, or a thank-you that asks for a video after a Google click. The free review check and the dashboard now read Google data only through Google's official APIs (Google Maps Platform and, once connected, the Google Business Profile API). We stopped using DataForSEO and SerpApi, no longer keep Google ratings or reviews from the free check, and no longer send Google reviews to AI models. Google data they collected before this change is still stored while we delete it. Your dashboard shows your Google rating and reviews live from Google Maps until you connect your Google Business Profile. Section 10 now says that Google Maps content in TripleReviews is subject to Google's terms.

What changed on October 5, 2026: section 07 and the Acceptable Use Policy now require your customers' prior express written consent for texts, a consent record that you keep, "Reply STOP to opt out" in every text, and the details carriers need to register your business. Texting is not turned on for any account yet, so these apply from the day it is turned on for you.

Complaints and disputes.

How to raise a problem, and what happens next.

If something isn’t right, tell us first: email info@triplereviews.com with “Complaint” in the subject, or use the contact page. A person replies within 1 business day, and we aim to resolve it within 10 business days. If it isn’t resolved by then, the owner of Resonate Agency LLC reviews it personally and replies to you.

We keep a record of every complaint and what we did about it. Nothing here limits any right you have under the law, including the governing-law terms in section 16.
